杨涛：陈同海到底能在监狱里蹲几年

　　7月15日上午，北京市第二中级人民法院对中国石油化工集团公司原总经理、中国石油化工股份有限公司原董事长陈同海作出一审判决，认定陈同海犯受贿罪，判处死刑，缓期两年执行，剥夺政治权利终身，并处没收个人全部财产。法庭审理查明，陈同海收受他人钱款共计折合人民币1.9573亿余元。(相关新闻见今日本报03版)

　　受贿近两亿，却只判死缓，这多少有些出人意料。但我并不想在判刑问题上过多纠缠，因为根据法院所陈述的对其从轻处罚的理由，判处死缓也是适当的。我所思考的则是陈同海判处死缓后，到底能在监狱呆多久的问题。

　　这并不是一个无关重要的问题。因为判处死缓，并不意味着牢底坐穿，而是有许许多多的方式和制度漏洞，可以让贪官坐几年牢就回家享清福。通常来说，判处死缓两年后一般会减刑为无期徒刑，而无期徒刑两年后一般会减刑为20年或者15年，而后，如果“表现良好”，又可以继续减刑或者假释。如果将所有的制度用足，贪官也许坐十几年牢就可以回家了。

　　更重要的制度漏洞还在于保外就医。比如，号称云南烟王的褚时健因为贪污1300多万元自1999年被判处无期徒刑后，2002年就被保外就医，如今正生龙活虎地进行二次创业。我国目前还没有对贪官保外就医的情况进行过调查，但从现实来看，贪官保外就医的情形并不少见。目前，保外就医通常由监狱单方面决定，不需要司法审查，外界监督也很难，贪官往往利用人脉关系和金钱，就可享受保外就医。因此，我们完全有理由相信陈同海在监狱呆几年，也可通过保外就医而出狱。同时鉴于保外就医往往不需要以坐多少年牢为前提(而减刑假释都有最低限度，如减刑最多只能减到实际刑期的一半)，如果滥用保外就医，其对正义的杀伤力比减刑、假释更强。

　　因此，对陈同海的审判，我们不仅要关注陈同海判了几年刑，更应当关注他实际会坐几年牢，关注在对他执行刑罚中可能出现的腐败问题。正义不仅要在判决中体现，也应当在执行中体现。
