NEW DELHI: If you are somebody who paid a hefty amount to buy a branded Oakley sunglasses only to discover they arefake, here is a good news for you.

Alarmed at the proliferation of spurious sunglasses of a popularworld famous brand, the Delhi High Court has recently ordered a crackdown onshops spread

across the city dealing in its counterfeit product.

 

Taking a serious view of copyright infringement, Justice SMuralidhar has in a recent order, also appointed local commissioners andempowered them to

seize fake sunglasses from these shops/factories/warehouses,make an inventory of items and produce them before the court.

 

Infact, armed with HC's directive, authorities have alreadyconducted raids at Gaffar Market, Karol Bagh and seized fake items to the tuneof several lakhs of rupees.

 

HC decided to restrain sale and manufacture of counterfeitsunglasses on a civil suit filed by `Luxottica' where it had complained ofmassive commercial losses due to

unchecked counterfeit sale.

It urged HC to intervene and send a strong message to shoppersselling fake product. The plaintiff also informed HC that "illicit tradeof grey and counterfeit products

causes multicrore losses to the eyewearindustry in India and a corresponding loss of taxes and other levies to theGovernment, apart from the consumer.''

 

The petitioners further tabled evidence before Justice Muralidharabout what they had unearthed on account of private investigations by hiredinvestigators. Samples

from various shops in the capital were obtained whichturned out to be fake.

 

"This court is satisfied that local commissioners should beappointed to visit the premises of the defendants (shop owners) at the variouslocations with the assistance

of two representatives of the plaintiffs tosearch these premises, seize and make an inventory of all counterfeitproducts,'' HC said, saying that the local police station

should assist inraids conducted against shops. HC has also empowered the commissioners to raidwarehouses and factories of those selling fake goods.
